Terms of Use

At Sparesbox South Africa, we prioritize transparency, and it’s essential that our valued community members are well-informed about our terms and conditions when accessing www.sparesbox.co.za. By using this website, you agree to abide by the following terms:

Legal Framework

Our website, www.sparesbox.co.za (referred to as the “Site” or “Website”), serves as an automotive shopping platform where you can explore, select, and order automotive spare parts provided by Sparesbox.

By accessing our site, you consent to receiving communications from us and our third-party service providers. You also agree to accept the use of “cookies” and similar technologies by this Website to enhance our services. Furthermore, you acknowledge that we may contact you via phone or email regarding incomplete or unconfirmed inquiries made through our Website. Additional details on data usage can be found in our Privacy Policy.

Your Legal Rights

When purchasing goods, your rights are subject to specific laws, including but not limited to South African consumer protection legislation. These legal provisions grant you certain rights that cannot be waived, such as the requirement for goods to meet acceptable quality standards, be fit for their specified purpose, and match the relevant product description. These Terms and Conditions do not intend to exclude or limit any legal rights implied by law, which cannot be excluded, limited, or modified.

Disclaimer

We take great care to ensure the accuracy of the information on our website at the time of publication. However, we disclaim any responsibility for any adverse consequences resulting from your reliance on this Site or its content. We are committed to rectifying any inaccuracies promptly upon becoming aware of them. The illustrations and photos on the Site serve as sample representations of the advertised products, and occasional variations may occur.

Changes

Sparesbox reserves the right to modify or discontinue any features of this Site, including content, availability hours, and may impose restrictions on specific features and services, or limit your access to parts or the entire Site without prior notice or liability. As we always aim to offer competitive prices, we also retain the right to alter product prices displayed on the Site at any time.

Orders

When you submit an order, it constitutes an offer to purchase goods at the prices and shipping charges displayed at the time of order submission, along with any relevant additional shipping charges or international shipping fees. The acceptance or rejection of your offer is at the sole discretion of Sparesbox. We may, for example, decline orders for commercial quantities of goods. If you intend to order commercial quantities, please contact support@sparesbox.co.za.

Please ensure that you provide accurate and complete information when placing an order. By submitting an order, you affirm that all details you provide are truthful and complete. If you place an order on behalf of another person, you must obtain their consent before sharing their personal information with Sparesbox. By placing the order, you confirm that you have obtained such consent. Sparesbox reserves the right to modify accepted payment methods for orders at its discretion.

Sparesbox does not guarantee the dispatch, delivery, or product availability within the estimated delivery times mentioned on the product page or during checkout, or any other specified timeframes, either by Sparesbox or its staff.

Shipping and Delivery

When you place separate orders, the goods will be delivered individually, and a separate shipping charge (plus any additional shipping charges or international shipping fees if applicable) will apply to each order. We cannot consolidate separate orders for combined delivery.

If you order multiple items in a single order, we will dispatch all accepted goods together when feasible. However, in some cases, goods may be dispatched separately due to different locations, types, dimensions, or availability statuses.

In addition to the website’s displayed price, you may be required to pay additional shipping charges not shown in your shopping cart. These charges apply if your delivery location necessitates light aircraft or barge transport or if our delivery partners do not provide door-to-door service to your area. Such charges may apply even if the item is labelled as “free delivery” or similar on the website. If an additional shipping charge applies to your location, Sparesbox will contact you with a quote, and your order will not be dispatched until you confirm your acceptance and make the necessary payment.

If you have provided a PO Box or Postal Locker as the delivery address and it’s not feasible to deliver the goods to such an address, Sparesbox will contact you to arrange an alternative delivery location.

You agree and acknowledge that Sparesbox cannot guarantee the dispatch, delivery, or product availability within the estimated delivery times mentioned on the product page, during checkout, or any other specified timeframes.

Stock availability and external factors beyond Sparesbox’s control (such as adverse weather conditions, traffic, and government actions) may result in delays or, in some cases, prevent timely product delivery. Delays are more likely during peak sale periods, such as around holidays.

Unless otherwise expressly stipulated in these Terms and Conditions or mandated by applicable law, neither Sparesbox nor its agents will be held responsible for any losses, damages, costs, or expenses resulting from delayed product delivery or product availability, whether under contract, negligence, tort, equity, restitution, strict liability, statute, or any other legal theory. This limitation also applies to the South African Consumer Law.

Order Cancellation

Sparesbox retains the right to cancel an order it previously accepted at any time and for any reason. Examples of such cancellations may include:

(a) Inability of Sparesbox suppliers to fulfil their commitments to provide goods. (b) Events beyond Sparesbox’s control (e.g., natural disasters, strikes, power failures) that prevent timely product delivery. (c) Errors in goods ordered due to website inaccuracies (e.g., description, price, or image) that were not identified before the order acceptance. (d) Your request for order cancellation. Sparesbox will make reasonable efforts to cancel or modify the order if it has not yet been shipped, but we cannot guarantee the success of this action.

Product Prices

The prices displayed on the Site represent the full cost in South African Rand (ZAR), including Value Added Tax (VAT), for the product itself. However, these prices do not include postage or delivery charges, which are location-dependent.

If you are shipping to a non-metropolitan area or if your delivery location is outside our stipulated radius then you may incur shipping fees. Please refer to our shipping information for more details.

Intellectual Property

This Site contains material protected by copyright, registered and unregistered trademarks, owned by Sparesbox and various third parties (referred to as “intellectual property rights”). You are prohibited from using our material, trademarks, or our name without our prior written consent.

Online Purchasing Account

You agree to provide accurate and complete email addresses, delivery addresses, billing addresses, and telephone numbers. Keeping these details up-to-date is your responsibility. Providing incorrect information may lead to delivery delays or non-delivery of your products.

By placing an order with Sparesbox, you grant us permission to send you marketing emails. You can opt out or unsubscribe from these emails at any time by following the unsubscribe link provided at the bottom of all emails sent by Sparesbox.

Limitation of Liability

Sparesbox will not be liable for lost profits, savings, reputation, goodwill, commercial or economic losses, or indirect, incidental, punitive, special, or consequential damages arising from the sale of products or services by Sparesbox or their use, regardless of whether such damages are based on tort, warranty, contract or any other legal theory – even if Sparesbox has been advised, or is aware, of the possibility of such damages.

Sparesbox’s aggregate and cumulative liability towards Buyer under any agreement shall not exceed an amount of ten percent (10%) of the related agreement.

Any Buyer’s claim for damages must be brought by Buyer within ninety (90) days of the date of the event giving rise to any such claim and any lawsuit relative to any such claim must be filed within one (1) year of the date of the claim. Any claims that have been brought or filed not in accordance with the preceding sentence are null and void.

The limitations and exclusions set forth above in this Limitation and Liability Section shall apply only to the extent permitted by applicable mandatory law.
